Cherokee tribe kicks out slave descendants

THOUSANDS OF black slave descendants who had the rights of Cherokee tribe members have now been stripped of these rights.

Their rights, received because the native American tribe had owned their ancestors, were revoked on Monday (August 22) when the Cherokee Indian Supreme Court in the US upheld the tribe's decision to formally remove their membership.

The court sustained the 2007 regulation made by the Cherokee nation to kick the so-called 'Freedmen' out of the tribe, overruling a previous vote made after the Civil War, which allowed the Cherokees to admit nearly 3000 African American slave descendants to the tribe.

In the 1830s, the Cherokee nation, which was driven out of much of the east coast by land grabbing white settlers, headed south in what is known historically as The Trail of Tears. Many of the tribe brought their slaves with them on the commute.

The news comes several months after a district court gave equal tribal citizenship rights to descendants, reportedly allowing the "Freemen" to be eligible for free health care and education in the US, amongst other benefits.

Reacting to the ruling, Freedman leader and plaintiff, Marilyn Vann, told the Daily Mail : "This is racism and apartheid in the 21st Century."

A spokesperson for the Cherokee's has not yet responded to the ruling.

Really this is very Good for them. Cherokee property, benefits and culture belong in the hands of Cherokee people. This is the very good chance to grow once again independently with their culture and tradition.

Why do the black americans so desparately want people to see them other than just black. everywhere you turn in america even the blackest one with the widest nose is claiming irish, cherokee native this that, its just strange and confusing. There are so many whites with drops of black and asian blood but they still only call themselves white, so why is it so hard for black americans to see themselves as just black?

Forget cherokees, forget what happen in your blood years ago america is still a rich country go stand on your feet and be just black its not hard.

Every racial, religious or ethnic group has some ugly or, conversely, overly polite term for the child of "mixed" breeding, but little welcome. Like saying, the President isn't black enough. One is born and raised in circumstances utterly beyond their control and forced for the rest of their life to eat the fruit of those circumstances. But... not allowed to participate fully on either side. Half breed or quarter or eighth, you aren't really one of us. Native people claim a virtue above the white and yet, like the politics of Washington, it really boils down to economics, doesn't it? Worse than taking away rights, the council has taken away identity, taken away personhood. To reject the descendants of any who walked the Trail of Tears is shameful and The Father who watches will judge.

It is shameful to say I am a Cherokee by blood and my heritage links back to Nancy Ward. A full-blood Native American known as Ghi-ga-u" and translated as "Beloved Woman," rose to prominence in the tribe during war with the Creeks and whose assistance to settlers in Tennessee made her a popular figure. Holders of this title had a right to speak and vote at Cherokee Councils and had supreme pardoning power; both rights Nancy used through most of the remainder of her life. For her valor, she was awarded some of the spoils of war, including captured slaves.. In 1785 at Hopewell, South Carolina, the new U. S. government and the Cherokee agreed to a treaty At the signing, Nancy Ward wrote, "I am glad there is now peace, I take you by the hand in real friendship. I have a pipe and a little tobacco to give the commissioners to smoke in friendship. I look on you and the red people as my children. Your having determined on peace is most pleasant to me for I have seen much trouble during the late war. I am old, but I hope yet to bear children who will grow up and people our Nation, as we are now under the protection of Congress and shall have no more disturbance. The talk I have given you is from the young warriors I have raised in my town, as well as myself. They rejoice that we have peace, and hope the chain of friendship will never more be broken." Although a few Cherokees managed to escape the ensuing round-up of Native Americans by taking refuge in the mountains of North Carolina (where some of their descendants still live today), most of the members of the Cherokee nation were destined to enforced exile {WHICH THEY ARE NOW DOING TO THE FREEDMEN} *Beginning in the spring of 1838, the dispossessed Native Americans were made to travel through rain and mud, and then snow and ice, to lands west of the Mississippi. About 4,000 Cherokees died during the 800-mile exodus that would eventually become known among them as the "Nunna-da-ult-sun-yi" (The Trail of Tears).
I said all that to say, I am a black native and many of my people are also of African decent known as Cherokee freedmen with native blood running just as prevalent through their viens as those who are to stop our existance of ever being part of this tribe. Our ancestors traveled the trail of tears and even intermingled with Cherokee's having children. Some were declined a roll # and for that reason was not able to be listed as a citizen of this tribe until 2007. Facts need to be recognized before speaking on. Freedmen to take a stand we will fight for whats rightfully ours. We will protest and vote on election day regaurdless. We will continue to support our true tribal nation. We will continue to go for our scheduled Dr.'s appointments. We will assume all benefits other relevent Cherokee's receive. We will prevail and over turn the Cherokee Supreme Court Decision. I guess the Indian chief feel it's time the slave descendants hacked it on their own without the sustenance.

I wonder how the Freedmen were to win a case against ----the Cherokee Nation who wanted them stripped of their rights AND ----the CHEROKEE INDIAN SUPREME COURT. They would need to be represented by a CHEROKEE INDIAN LAWYER or a lawyer that specializes in CHEROKEE INDIAN LAW.
These Freedmen must have been poorly represented.

The 2800 Cherokee Freedmen descendants who would be affected by this court decision did not join the tribe until after a 2006 Cherokee Nation Supreme Court ruling.

There are, however, over 1500 Cherokee Freedmen descendents who also have ancestors on the Cherokee Dawes Rolls who are enrolled in the tribe and will remain so. This ruling doesn't affect them or any other Black Cherokee, as not all African-Cherokee people are Freedmen descendants.

As a black person I would'nt blaim any noneblacks if they do not want to have any form of affiliation with us anymore. Look at the state of blacks, instead of going forwards, we go backwards.

Everything we own or create for ourselves, we allow noneblacks to come and take it from us without much of a fight. Whites and asians take things from us like they're taking candy from a baby! They dont have to take it anymore, we just hand it over to them.

People from other races, dont want black people to interbreed with them and pull them down, people from others races try their best to hold on to their culture and heritage for themselves, without sharing it with others.

The only thing we've got left is our music, which black people fought hook and nail to keep going, even through ridicules from whites and other races. Now look who is king of hip hop, eminem a white boy, and in the r&b and black music videos, whites and asians outnumbered the blacks, we've got nothing left.

We dont even have eachother anymore, every black community create sub groups and keep fighting eachother, we are the weakest link!
